Professional License Defense Attorney
California requires a professional license for many occupations and professions. There are dozens of state regulatory agencies, boards, bureaus and departments that issue and regulate occupational and professional licenses. The Administrative Law system in California allows state regulatory agencies, boards, bureaus and departments investigatory, hearing and enforcement power over occupational and professional licensees.
The filing of formal disciplinary proceedings begins with an Accusation. An Accusation contains the formal charges against the licensee, known in the Accusation as the respondent. The respondent normally has the right to request a hearing on the charges in front of an Administrative Law Judge employed by the California Office of Administrative Hearings. However, some California regulatory entities conduct their own hearings.
Most regulatory entities are represented in administrative law matters by the California Attorney General’s Office, although several agencies employ their own staff attorneys. Prior to the hearing, it is often possible to enter into a settlement with the administrative regulatory entity and Attorney General’s Office, known as a Stipulated Agreement.
If the matter proceeds to hearing, the Administrative Law Judge, or ALJ, issues a Proposed Decision. The California regulatory agency can then adopt the Proposed Decision, overturn the Proposed Decision or modify the Proposed Decision. If the respondent is not satisfied with the regulatory entity’s final decision, the licensee can file a Petition for Reconsideration with the respective California administrative agency, board, bureau or department. The respondent can also file a Writ of Mandamus, or Writ of Mandate, in Superior Court.
